Ethicon is a manufacturer of surgical mesh that has come under fire in recent years for complications related to its Physiomesh line of products. Numerous lawsuits have been filed accusing the Johnson & Johnson company of producing products that are unsafe. Patients have complained of suffering problems both soon after surgery and even years later. Some have experienced numerous recurring hernias. Additionally, there have been reports of infections that have led to fistulas, abscesses, and adhesions. Erosion of the mesh and migration of the larger pieces of mesh can lead to pain and organ damage. Once infection and growths begin in the body there can be increased risks of sepsis, permanent damage, and even death under very extreme conditions.

This is not the first time Ethicon has faced a similar problems. They withdrew many of their transvaginal mesh products from the market after patients experienced chronic pain, bleeding, and infections. Both its hernia mesh and transvaginal mesh were brought to market via the FDA’s 510(k) clearance process that expedites the time it takes to get a medical device to market. Questions are being raised as to whether the 510(k) process is too lenient.

As Ethicon faces an onslaught of lawsuits, an MDL was established for the cases against Ethicon in the Northern District of Georgia. These suits are ongoing and Plaintiffs continue to join them. At the same time Ethicon has decided to execute a market withdrawal in the United States. Interestingly, the European market has framed the situation as a voluntary product recall. The FDA has not posted a withdrawal notice, but has noticed on its site that there is the potential for increased complications related to Ethicon’s products. The difference between a market withdrawal and a recall is of degree alone.

Typically recalls stem from government action, but they can also be undertaken by manufacturers preemptively. A withdrawal generally means that the product is facing a minor violation, but would not be subject to legal action by the FDA. This is interesting in the case of Ethicon because there have been many studies indicating that Physiomesh in particular poses greater risks of complication. Additionally, accounts from affected consumers recount horror stories of serve injuries and side effects.

One plaintiff recounts having the Physiomesh patch attaching to her bowels and abdominal wall in such a way that it has been impossible to remove all of the mesh. This caused chronic pain, bowel obstruction, and diminished bowel motility. Other plaintiffs also explained recurrence of hernias coupled with severe adhesions that caused crippling pain and other complications.
